    CPP Policy Review Consultation

    As a result of comments received during the consultation process, the WSIB has approved new and revised policies that will change the way the WSIB calculates benefits for workers and survivors who receive both WSIB and CPP/QPP benefits as the result of a work-related injury/disease or death. The policy changes help ensure that the WSIB is providing fair compensation to workers, and in cases of work-related deaths, their survivors.

    Decisions regarding the policy changes were made after careful consideration of the legislation and input received from Ontario’s workers, employers, and their representatives.

    Two groups of workers and survivors will be affected by the changes:
    1. workers with CPP disability benefits offset from partial Future Economic Loss (FEL) or Loss of Earnings (LOE) benefits when their post-injury earnings are deemed (estimated)
    2. survivors with CPP children’s survivors’ benefits offset from WSIB survivors’ benefits.
    The affected workers and survivors can expect to see their ongoing benefits increase and to receive an adjustment cheque for any benefits payable after the effective date of the policy changes, January 1, 2004. The WSIB will be processing and sending adjustment cheques to workers and survivors from June through September 2005.

    One new policy was created and six existing policy documents were revised to reflect the CPP policy changes. The two key policies are:
    • #18-01-13, Calculating CPP/QPP Offsets from FEL/LOE Benefits (new policy)
    • #20-03-03, Calculating CPP/QPP Offsets from Survivors’ Benefits (revised policy).
    Minor changes were made to five other policies:
    • #18-03-03, Reviewing LOE Benefits
    • #18-04-05, Initial Determination - Workers Who are Earning at Time of Determination
    • #18-04-06, Initial Determination - Where Suitable Employment or Business has been Determined
    • #18-04-14, Reviewing FEL Benefits
    • #22-01-02, Material Change in Circumstances – Workers.
    All policies are now available in the online Operational Policy Manual.
