What is a “Policy” Consultation
Following consultation with stakeholders, the Board of Directors approved its proposal on what is a “policy” for purposes of Section 126 of the Workplace Safety and Insurance Act.
Section 126 of the Act states that the Workplace Safety and Insurance Appeals Tribunal must apply WSIB policies when the Tribunal makes decisions.
The section also says, however, that the Tribunal has the power to decide that a policy is inconsistent with, or not authorized by, the Act, or that a policy simply doesn’t apply to a particular claim.
It provides that a “policy”
- must be published in a policy manual
- must be “minuted” if published in a policy manual after July 1, 2001.
